Za zam\u00edtnut\u00fdmi \u00fav\u011bry v bank\u00e1ch stoj\u00ed mnohdy slo\u017eit\u00e1 legislativa, nikoliv neochota bank p\u016fj\u010dovat, jak se mnoz\u00ed \u017eadatel\u00e9 myln\u011b domn\u00edvaj\u00ed. \u010cesk\u00e1 n\u00e1rodn\u00ed banka d\u00e1v\u00e1 za povinnost bankovn\u00edm subjekt\u016fm d\u016fkladnou lustraci ka\u017ed\u00e9ho \u017eadatele. Pokud b tak neu\u010dinily, mohlo by to pro n\u011b znamenat nedoz\u00edrn\u00e9 n\u00e1sledky. Dlu\u017en\u00edk by mohl celou smlouvu napadnout pro jej\u00ed neplatnost a nad\u00e1le spl\u00e1cet dlu\u017enou \u010d\u00e1stku dle sv\u00fdch mo\u017enost\u00ed bez \u00farok\u016f a dal\u0161\u00edch poplatk\u016f. Spot\u0159ebitelsk\u00fd z\u00e1kon tak chr\u00e1n\u00ed nejenom samotn\u00e9ho dlu\u017en\u00edka, ale i poskytovatel\u00e9 \u00fav\u011br\u016f. Mnoho nebankovn\u00edch poskytovatel\u016f se ale ke sv\u00fdm \u017eadatel\u016fm benevolentn\u011bj\u0161\u00ed a je mo\u017en\u00e9 u nich nakonec z\u00edskat hypot\u00e9ku, i kdy\u017e v\u00e1\u0161 finan\u010dn\u00ed rejst\u0159\u00edk nen\u00ed zrovna bez poskvrnky.
